Two class action lawsuits involving Cargill, Incorporated received preliminarily settlement approval in the United States District Court for the District of Hawaii on July 24, 2014.

Under the proposed settlement, all persons who from July 1, 2008 through July 24, 2014 (the “Class Period”) resided in the United States and purchased in the United States any of the Truvia Consumer Products for their household use or personal consumption and not for resale are potential class members may be entitled to participate in a proposed class action settlement.

Qualifying class members who submit a valid and timely Claim Form postmarked on or before December 5, 2014, may be eligible to receive a cash refund or Vouchers for free Truvia Natural Sweetener products.

The two lawsuits – known as Denise Howerton, et al., v. Cargill, Inc. and Molly Martin and Lauren Barry v. Cargill, Inc. – challenge the labeling and marketing of Cargill’s Truvia Natural Sweetener products. This proposed settlement is a resolution to these lawsuits. The Court has scheduled a Final Approval Hearing (“Fairness Hearing”) for October 27, 2014, to decide whether to approve the settlement. The Court will consider whether the terms of the settlement are adequate and fair; listen to people who filed valid objections to the settlement and asked permission to speak at the Fairness Hearing; and may also decide how much to award Class Counsel for fees and expenses for representing the Class and whether and how much to award the Plaintiffs for their service as Class Representatives. Settlement benefits cannot be distributed to eligible Class Members who file valid and timely Claim forms until final settlement approval is received from the Court and all appeals are resolved.

As a potential Class Member, you may submit a claim to be eligible to receive benefits, request exclusion from the Settlement class, file an objection with the Court and ask to speak at the hearing if you wish, or do nothing.
