Arbitration Rights

As a participant in arbitration, you are entitled to receive a fair arbitration process. Specific policies vary by provider, as they are largely based on the providers’ arbitration rules. While it is important to read and understand the rules that govern arbitration, several providers make available summaries of the fairness principles and rights granted to parties, as derived from their rules.

The American Arbitration Association has a document called the "Consumer Due Process Protocol" that is available on the AAA website.

The National Arbitration Forum has a document called the "Arbitration Bill of Rights" that is available on the FORUM page.

JAMS has a document called the "JAMS Policy on Consumer Arbitrations Pursuant to Pre-Dispute Clauses Minimum Standards of Procedural Fairness" that is available on the JAMS website.
